It’s a Win for Katy Perry

Katy Perry will be appearing as a special guest on the upcoming season of MasterChef Australia on Network 10.

“CONFIRMED: Her iconic song is the theme to MasterChef Australia, and we were thrilled to welcome Katy Perry to the MasterChef kitchen for an extra special episode. Season 12, Coming soon!” the show wrote on Instagram, along with a photo from her appearance.

Katy appears in an episode which involves an immunity challenge based around her song “Hot N Cold,” which has been the opening theme song of the series for the past 11 seasons.

Meanwhile, Perry has been found not liable for infringement. After half a year after a California jury found that Katy, collaborator Dr. Luke and Capitol Records were guilty of ripping off Christian rapper Flame’s work for her 2013 hit “Dark Horse,” a California federal judge found her not liable on Tuesday.

As a result, Marcus Gray, known professionally as Flame, finds his $2.8 million jury verdict wiped out. U.S. District Court Judge Christina Snyder came to the conclusion after reviewing the evidence presented at the July trial and found that Gray can’t satisfy the extrinsic test, which requires that a copyright plaintiff identify concrete elements based on objective criteria that the works are similar.

“It is undisputed in this case,” Snyder wrote, “that the signature elements of the 8-note ostinato in ‘Joyful Noise’… is not a particularly unique or rare combination.”

Snyder drew on the testimony of the plaintiff’s expert witness, musicologist Todd Decker, in coming to her conclusion that the jury got it wrong.

“A relatively common 8-note combination of unprotected elements that happens to be played in a timbre common to a particular genre of music cannot be so original as to warrant copyright protection,” she wrote.
