Cherry Creek resident sues neighbour, TNRD, province over flood damage
KAMLOOPS — A Cherry Creek resident is taking legal action after flooding in 2017 and 2018 caused damage to her property.
Corine Lebourdais claims a washed-out culvert in her neighbour’s property and repair work done to the highway have both contributed to damage to the hillside beside her property. Both incidents were the result of the flooding of Cherry Creek.
Lebourdais has filed a lawsuit against the guardian of the estate adjacent to her property, the Thompson-Nicola Regional District, the Ministry of Transportation and the Ministry of Forests. The lawsuit claims the defendants were negligent, allowing for or implementing changes to the path of the creek, which has contributed to the damage.
