Fraser found guilty in 2017 stabbing death of Cody Foster

KAMLOOPS — Lawyers and family members of Cody Foster hugged and cried moments after a jury found Stephen Fraser guilty of the stabbing death of Foster.

A unanimous decision was handed down in Kamloops Supreme Court today (Dec. 13), after roughly a day and a half of jury deliberations. The jury determined Fraser was guilty of the charge of second-degree murder.

Foster’s sisters, Nikki and Dana, joined by family friends, were emotional as the decision was handed down. For them, this is the first step of moving on.

Foster’s sisters will always miss and remember him, they say, but this is the first time they’re able to look ahead now that the legal process is over.

Fraser is 58 years old now, and will be given a life sentence for Foster’s murder. But it will be up to Supreme Court Justice Len Marchand to determine a parole eligibility period next year.

Foster was stabbed to death in his Dallas trailer in February 2017, after he and Fraser had spent much of the afternoon together one Saturday.

On the stand, Fraser told his side of the story — saying Foster instigated the altercation by threatening to kill him. Fraser said he feared for his life when Foster made the alleged threat, so he grabbed a knife before a struggle led to him stabbing Foster numerous times.

But as Crown prosecutor Alex Janse pointed out in her closing arguments, there were no defensive wounds on either man. She said this meant there was no two-sided fight.

The jury began deliberating yesterday morning, and by 8:00 p.m. they retired, knowing a decision wouldn’t be reached. They reconvened at 9:30 this morning, and two hours later they had a decision.

Now that the trial has concluded, Janse hopes it will give some closure to the family.
