Judge decides today whether to recuse herself for crying in court

KELOWNA —   A Kelowna judge is expected to decide today whether she’ll recuse herself from sentencing a man for sexual assault because she cried during a victim impact statement.

    The man’s lawyer asked Judge Monica McParland to step aside because she shed tears during the victim’s statement and scoffed at the defence suggestion for a sentence.

    The Crown prosecutor countered that judges are supposed to show compassion and humanity and added the scoff couldn’t be heard on a court recording.

    Jeremy Carlson pleaded guilty to sexual interference of a minor and the Crown wants him to spend up to 20 months in jail, followed by probation. (The Canadian Press)
