LNIB granted injunction to access Mamit Lake rip-rap rock

MERRITT, B.C. — The Lower Nicola Indian Band says it has been granted a court injunction to access rip-rap rock stored on Gordon Garthwaite’s property.

The rock belongs to the LNIB, but Garthwaite had been blocking access to the material as part of a dispute over the spreading of biosolids.

LNIB Chief Aaron Sumexheltza had argued crews needed to access the rock in order to perform necessary prevention work on the Mamit Lake dam, but Garthwaite said the dam was in good shape and functioning well.

In a release, Sumexheltza said, “It is unfortunate that it had to come to court action,” and added, “This issue was not a matter for negotiation or exchange.”
